Terms of Use

These Terms of Use (“Terms”) govern your use of FungiLog, provided by Stargazer Apps, operated by an independent developer (“Stargazer Apps,” “we,” “us,” or “our”). By downloading, accessing, purchasing, or using FungiLog, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.

Eligibility

You must be at least 13 years old to use FungiLog. If you have not reached the age at which you can legally agree to these Terms where you live, a parent or legal guardian must review and agree to them for you. FungiLog is not directed to children under 13.

Intended use

FungiLog is a personal field-observation log and an informational and educational tool. It can help you photograph observations, keep notes, record locations, browse catalog information, and request optional AI-generated candidate suggestions. It is not a professional identification service, medical or toxicological advice, food-safety advice, emergency service, or substitute for a qualified mycologist.

AI, catalog, and reference limitations

AI systems can hallucinate, omit important facts, confuse species, misread images, express unjustified confidence, or produce inconsistent results. Image quality, angle, lighting, maturity, damage, geography, season, and missing microscopic, chemical, odor, spore-print, or habitat evidence can all affect an assessment.

Species names, common names, groups, risk or danger labels, confidence scores, reference photographs, descriptions, external links, and warnings may be incomplete, outdated, incorrectly attributed, misleading, or wrong. A missing warning does not mean a mushroom is safe. A catalog grouping that uses words such as “edible” is taxonomic or informational context only and is not approval to eat a specimen.

Only an appropriately qualified local mycologist examining the physical specimen and relevant field evidence can provide an expert assessment. Stargazer Apps does not select, supervise, endorse, or guarantee any expert or the result of any assessment. When in doubt, leave the mushroom untouched and do not consume it.

Your responsibility

You are solely responsible for your conduct, observations, notes, location choices, and decisions outside the app. You must follow applicable laws, land-access rules, conservation restrictions, and property rights. Do not trespass, disturb protected habitat, collect protected species, or expose yourself or others to unsafe terrain, wildlife, allergens, toxins, or weather.

Safety notices are material conditions of using FungiLog. Dismissing or accepting an in-app notice does not make an AI result reliable, transfer responsibility for a consumption decision to Stargazer Apps, or waive any right that applicable law does not allow you to waive.

User content

You retain ownership of photographs, notes, and other content you create. You represent that you have the rights and permissions needed to use and submit that content and that it does not violate law or another person's privacy, intellectual property, or other rights.

You grant Stargazer Apps a limited, non-exclusive, worldwide license to host, transmit, format, and process content only as reasonably necessary to provide the feature you request, including sending selected images and notes to service providers for optional AI analysis. This license ends when the processing purpose ends, except for copies or records retained as described in the Privacy Policy or required by law. Third-party providers process content under their own applicable terms.

Acceptable use

You may not misuse FungiLog or its backend, bypass access or usage limits, probe or interfere with security, automate abusive requests, reverse engineer protected service components except where law expressly permits, upload unlawful or harmful material, infringe rights, impersonate another person, distribute malware, or use the service to develop or facilitate harmful, deceptive, or illegal activity.

Premium subscription

Where offered, FungiLog Premium is an auto-renewing monthly subscription that can enable the features described in the app or store listing, such as a displayed allowance of AI analyses and removal of ads. Current price, taxes, billing period, included features, trial terms if any, and renewal details are shown in Google Play before you confirm a purchase. Feature availability and reasonable usage safeguards may change as permitted by law, but changes do not override rights stated at checkout or mandatory consumer rights.

Payment is charged to your Google Play account. Unless canceled before the renewal deadline shown by Google Play, the subscription renews automatically and Google Play charges the applicable price. Manage or cancel the subscription in your Google Play account settings. Deleting FungiLog does not cancel a subscription. Purchase restoration requires the same eligible store account and is subject to Google Play and RevenueCat availability.

Google Play processes payments, cancellations, and refund requests under its rules and applicable law. Stargazer Apps cannot access full payment-card details and cannot guarantee that Google will approve a refund. Nothing in these Terms limits any mandatory cancellation, refund, conformity, or consumer remedy available under applicable law.

Advertising and third-party services

The free version may display advertising. FungiLog also depends on or links to services supplied by Google Play, Google AdMob, RevenueCat, Cloudflare, Google Gemini, operating-system vendors, map or device services, and catalog-image or attribution providers. Their services, content, availability, and policies are outside our control. A link or reference does not imply endorsement, and your use of a third-party service may be governed by separate terms.

Local data and backups

Most observation content is stored locally. Device loss, damage, operating-system cleanup, uninstalling, file corruption, failed import, or app changes may result in data loss. Keep independent copies of information that matters to you and protect exported backups, which may contain photographs, notes, and exact coordinates. We do not guarantee that every backup will remain compatible forever.

Our intellectual property

FungiLog's software, design, branding, original text, and other Stargazer Apps materials are owned by or licensed to Stargazer Apps and are protected by applicable laws. These Terms grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the app for its intended purpose. They do not transfer ownership. Third-party photographs, names, data, libraries, and trademarks remain subject to their respective rights and licenses.

Availability, changes, and termination

We may maintain, update, restrict, suspend, or discontinue features to address security, legal, provider, technical, capacity, or business needs. AI, advertising, catalog synchronization, subscription validation, and external images require third-party services and network access and may be delayed or unavailable. We do not guarantee uninterrupted, timely, secure, or error-free operation.

We may suspend or terminate access to online features when reasonably necessary to protect the service, comply with law, respond to abuse, or enforce these Terms. You may stop using FungiLog at any time, but uninstalling does not cancel an active subscription.

Disclaimer of warranties

To the maximum extent permitted by applicable law, FungiLog and all outputs, catalog information, and online services are provided “as is” and “as available,” without express or implied warranties, including warranties of accuracy, identification, edibility, safety, fitness for a particular purpose, merchantability, non-infringement, availability, or error-free operation. We do not warrant that any content will identify a specimen or prevent poisoning, injury, illness, death, property loss, or data loss.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent legally permitted.

Limitation of liability

To the maximum extent permitted by applicable law, Stargazer Apps and the independent developer operating it will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages; lost data, profits, revenue, opportunity, or goodwill; or claims arising from reliance on an AI output, catalog entry, reference image, warning, location record, third-party service, or unavailable feature.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability that applicable law makes non-excludable. These Terms do not remove mandatory consumer protections or remedies.

Indemnity

To the extent permitted by applicable law, you agree to be responsible for losses, claims, or reasonable costs arising from your unlawful misuse of FungiLog, infringement of another person's rights, or material breach of these Terms. This section does not apply where responsibility cannot lawfully be imposed on a consumer or where the loss was caused by Stargazer Apps.

Governing law and disputes

These Terms are governed by Turkish law, without regard to conflict-of-law principles. This choice does not deprive a consumer of mandatory protections or access to a competent court, consumer arbitration committee, regulator, or other forum available under the law that applies to that consumer. Before filing a dispute, you may contact us and give us a reasonable opportunity to address the issue informally.

General terms

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions continue in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy form the agreement concerning FungiLog, subject to any additional mandatory store terms or checkout disclosures.

Changes to these Terms

We may update these Terms when FungiLog, its providers, or legal requirements change. We will publish the revised version at this URL and update the effective date. If applicable law requires additional notice or consent for a material change, we will provide it. Continued use after an effective update constitutes acceptance only to the extent permitted by law.
